Lasting Power of Attorney

A Lasting Power of Attorney is a legal document within which you appoint people that you trust to make decisions in your best interests on your behalf whilst you are alive. They may need to act if you were either physically or mentally incapable of managing your own affairs.

There are three types of lasting power of attorney:

1. One for property & financial affairs

2. One for your business property & financial affairs

3. One for your health & welfare

Why is it necessary?

In the event of losing mental capacity in the absence of a lasting power of attorney, the Court of Protection would have the power to take control of your affairs. Responsibility doesn’t automatically pass to your loved ones, or business associates.

A lasting power of attorney isn’t just for the elderly. Accidents or illness can strike at any time with dire consequences if you’re not adequately protected. If you want to determine who makes decisions on your behalf, a lasting power of attorney is vital.

Probate

Probate is the name given to the process of obtaining the legal right to deal with someone’s estate when they pass away.

Why is it necessary?

Following your death, if the assets you leave behind are more than a certain value, your chosen executor may have to apply to the court in order to carry out your wishes.
