  • Do you have any long-term health problems? Potentially disability discrimination.
  • Have you ever taken a prolonged period of time off work? If so, what were the reasons? Potentially disability discrimination.
  • We need more ‘young blood’ in this company. Potentially age discriminatory.
  • There always seems to be someone getting pregnant. Potentially sex discrimination and/or pregnancy and maternity leave discrimination.
  • No-one’s taking any more time-off work to be ill until we sort the problem out. Potentially constructive dismissal for breach of trust and confidence and/or disability discrimination.
  • I don’t care how long you have to work today just get it done by the deadline. Potentially constructive dismissal for breach of trust and confidence and/or breach of the Working Time Regulations.
  • We intend to dismiss you for poor performance/misconduct unless you accept the proposed settlement agreement/offer. Potentially constructive dismissal for breach of trust and confidence.
